CCI rules out case of abuse of dominant position by ‘CICTPL’ in the relevant market of sea-ports in India

COMPETITION LAW : Where it was alleged that CCTPL being one of terminal operators at Kamarajar Port was dominant in relevant market of provision of common user coal terminal services at sea-ports in and around Kamarajar Port, however, it was found that presence of Krishnapatnam port posed significant competitive constraints on CICTPL, so much so that latter could not be held as dominant.
